
What Is Identity Misuse?
Identity misuse happens when someone else uses your personal data (ID card, family card, tax ID, etc.) to apply for financing, whether intentionally or without the permission of the identity's rightful owner.
The Legal Basis
The legal basis is set out in the Personal Data Protection Law (Law No. 27 of 2022). This law prohibits the unlawful use of personal data, including data forgery or using someone else's identity data to benefit oneself or others.
Under Article 67 of the Personal Data Protection Law, violations can be punished with up to 4-6 years in prison and fines of up to IDR 5-6 billion, depending on the type of violation.
